The petitioner seeks bail in Sheikhpura P.S. Case No. 273/2018, registered for the offence punishable under Section 364(A) of the Indian Penal Code.
Informant has alleged that on 30.04.2018, her grand-son became traceless. Even after search, he could not be found. Her neighbour informed that he saw her grand-son with a person. On the next day, informant got a letter in which Rs. 2.5 lakh was demanded, as ransom. Victim at the time of recovery was in company of petitioner.
It has been submitted that petitioner has falsely been implicated in this case. He is not named in the F.I.R. No
Patna High Court Cr.Misc. No.49262 of 2018 (3) dt.27-09-2018 incriminating material has been found against him. In fact, petitioner is relative of the informant.
Petitioner has no criminal antecedent. He is in custody since 04.05.2018.
Considering the facts and nature of allegation, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
Petitioner may renew his prayer for bail after completing one year in custody.
