2. Learned counsel for the informant has filed Supplementary Affidavit in the course of the day which is kept on record.
3. The petitioner has preferred this application for grant of regular bail in connection with Nawada Town P.S. Case No. 869/2024 dated 28.07.2024 registered for the offence punishable u/s 96 of the B.N.S.
4. As per the prosecution case, the petitioner and the co-accused persons are alleged to have kidnapped the minor nephew of the informant by enticing her. The informant has further alleged that her nephew took away Rs.15,000/- along
Patna High Court CR. MISC. No.57173 of 2025(3) dt.16-09-2025 2/3 with her.
5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. There was love affair between the parties. As per Supplementary Affidavit filed on behalf of the petitioner, the victim girl is residing with her family and she has given birth to a male child on 29.07.2025 at Sadar Hospital, Nawada. The petitioner has nine antecedents and in all the cases he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 10.02.2025.
6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the victim is a minor girl.
7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Nawada Town P.S. Case No. 869/2024, with the condition:- (i). The petitioner is directed to remain physically
Patna High Court CR. MISC. No.57173 of 2025(3) dt.16-09-2025 3/3 present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
