JUSTICE SANJAY PRIYA ORAL ORDER 24-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sono P.S. Case No. 102 of 2018 instituted for the offence under Sections 363, 365, 302, 201 and 120B of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has come in confessional statement of co-accused Gopal Tamauli made in paragraph-48 of the case diary. Counsel for the petitioner further submits that co-accused Rinku Barnwarl @ Dinesh Barnwal with similar allegation has been granted bail by coordinate Bench of this Court vide order dated 24.07.2018 passed in Cr. Misc. 36766 of 2018.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the
Patna High Court Cr.Misc. No.42949 of 2018 (3) dt.24-09-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Jamui, in connection with Sono P.S. Case No. 102 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
