JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section and other allied sections 376/506 of the Indian Penal Code and section 4 of the POCSO Act.

As per the prosecution case, this petitioner committed rape on the minor daughter of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is delay in lodging of the FIR and there is no explanation of delay. Medical report does not support the allegation. Petitioner is 74 years old and as such allegation appears to be improbable. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in

Learned counsel for the State opposes the prayer for bail and submits that the victim in her section 164 Cr.P.C. statement has supported the prosecution case.
