.... .... Petitioner/s

Versus

1. The State of Bihar through Collector, Sheikhpura, P.S. and District - Sheikhpura.

2. The Collector, P.S. and District - Sheikhpura.

3. The Commissioner, Mines and Geology, Govt. of Bihar, Patna. .... .... Respondent/s =========================================================== Appearance :

For the Petitioner/s : Mr. Arbind Kumar Singh For the Respondent/s : Mr. AAG2-D.K. Sinha =========================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL JUDGMENT Date: 07-09-2018 1.

The present writ petition has been filed for quashing the order dated 18.12.2012 passed by the Collector, Sheikhpura as also for quashing the order dated 04.04.2014 passed by the Commissioner, Mines and Geology, Government of Bihar, Patna in Revision case no. 2 of 2013.

2.

The issue in the present case is very short i.e. to the effect that the Commissioner, Department of Mines and Geology, Government of Bihar, Patna by an order dated 04.04.2014 remanded the matter back to the Collector, Sheikhpura to pass a fresh order, thereby annulling the order dated 18.12.2012 passed by the Collector, Sheikhpura. Thus, as far as quashing of the order dated 18.12.2012 is concerned, the same being an order of remand, requires no interference.

Patna High Court CWJC No.22030 of 2014 dt.07-09-2018 2/2 3.

Having considered the entire matter in a holistic perspective, I find that it would be appropriate to dispose of the case with a direction to the Collector, Sheikhpura to pass a final order in compliance of the order dated 04.04.2014 passed in Revision case no. 2 of 2013 within a period of 12 weeks from today. 4.

The writ petition is disposed of on the aforesaid terms. (Mohit Kumar Shah, J) rinkee/- AFR/NAFR NAFR CAV DATE NA Uploading Date19.09.2018 Transmission Date NA
