JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-02-2015 This is the third attempt on behalf of the petitioner for grant of bail in a case registered for the offence under section 395 of the IPC. First application was rejected by this court vide order dated 14.12.2012 passed in Cr. Misc. No. 44132 of 2012. He thereafter filed Cr. Misc. No. 13032 of 2013 which was dismissed by an order dated 23.04.2013 making the following observation in paragraph 17:- "17. In the present case as in my opinion the petitioner has not made out a fresh ground for renewal of his prayer for bail, the application is rejected. The petitioner shall not renew his prayer for bail till conclusion of the trial, unless any fresh ground is made out."
I do not find that any fresh ground has been made out in the present application for bail so that petitioner's case may be
Patna High Court Cr.Misc. No.5013 of 2015 (2) dt.04-02-2015 2/2 considered for grant of regular bail. This application is, therefore, rejected.
Learned counsel for the petitioner submits that though the charges were framed on 21.09.2013, there has been absolutely no progress in trial and the petitioner is languishing in jail since 26.07.2012.
In such view of the matter, it is observed that learned Adhoc Additional Sessions Judge, IV, Araria will try to expedite the trial.
