The petitioner has renewed his prayer for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

It is submitted by learned Senior counsel appearing for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 27.1.2021 passed in Cr. Misc. no. 28131 of 2020 giving liberty to the petitioner to renew his prayer for bail if no progress take place in the trial in the next 9 months. It is submitted that inspite of the petitioner being in custody since 22.5.2020 and more than 1 year 3 months having passed since the said order, the case is still to be committed to the Court of Sessions. Patna High Court CR. MISC. No.68386 of 2021(3) dt.17-05-2022 2/2 bail was also rejected by the above mentioned order dated 27.1.2021 has been enlarged on bail vide order dated 13.4.2022 passed in Cr. Misc. no.67718 of 2021.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order dated 27.1.2021, the petitioner having remained in custody since 22.5.2020, the stage in the learned trial Court wherein the case has still not been committed to the Court of Sessions and grant of bail to the coaccused Nikku Jha, the Court directs the petitioner to be enlarged on bail in connection with Birupur P.S. Case no. 22 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Lakhisarai.
