JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 06-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Danapur P.S. Case No. 255 of 2016 for the offences punishable under sections 387 and 120 (B) of the I.P.C.
Allegedly, ransom was demanded from the informant on his mobile through mobile no. 9504993145 by causing threats to kidnap his son and again in the way the miscreants stopped him at the point of gun and demanded ransom of Rs. 5,00,000/- by causing threats.
Submission is of false implication and that there is no legal evidence against the petitioner save and except confessional statement of Chhotu Kumar @ Kallu Kumar, earlier the petitioner
Patna High Court Cr.Misc. No.2816 of 2017 (4) dt.06-03-2017 2/2 was made accused on the basis of the confessional statement of that Chhotu Kumar in Danapur P.S. Case No. 256 of 2016 under sections 399 and 402 of the I.P.C. and in that case he was arrested but he has been released on bail, then in this case the police is searching him, in this case other co-accused including Chhotu Kumar have already been allowed regular bail by the court below itself, the petitioner was not apprehended at the spot with any arm and as such he deserves sympathetic consideration. The learned A.P.P. submits that the petitioner has got criminal antecedent.
In the facts and circumstances as stated above, considering that save and except confessional statement there is no other material against the petitioner and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M. Danapur in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
