The petitioner seeks bail in Uchakagaon P.S. Case No. 139/2018, instituted for the offences under Sections 302/34 of the Indian Penal Code.
It is alleged in the written report that the informant was cleaning utensils in the court yard. In the meantime, this petitioner with Jalaluddin Sheikh came at her door and started abusing and gave threat to the informant. On such, mother-in-law of the informant came and made protest then the accused persons became furious and assaulted her mother-in-law with lathi and danda after encircling her and with a view to kill her by pressing her in wall, this petitioner pushed the wall and door in which her
Patna High Court Cr.Misc. No.42231 of 2018 (3) dt.25-09-2018 2/2 mother-in-law came under the wall and died.
Post-mortem report is available in case diary, wherein doctor has found fracture of both side ribs.
Considering the aforesaid fact and circumstances, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected.
The petitioner is given liberty to renew his prayer for bail after six month in the event no substantive progress is made in trial.
