The petitioner apprehends his arrest in Bhargama P.S. Case No.80 of 2019, registered under Sections 379, 411 and 34 of the Indian Penal Code.

The informant alleged that his buffaloes were stolen and during the course of search, the informant found his buffaloes loaded on a pick up van. Bhutai Yadav, the driver of the pick up van, was apprehended.

It is submitted that the name of the petitioner was disclosed by Bhutai Yadav in his confessional statement. Save and except the confession of Bhutai Yadav, there is no material that the petitioner committed any theft of buffaloes of the informant and petitioner has got no criminal antecedent. Taking into consideration the facts aforesaid, let
