JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 16-022016 in a case registered under Section-307 & other minor sections of the Indian Penal Code.
Petitioner is said to have given Gadansa blow causing injury on the ear of the injured. The injured appears to have sustained altogether five injuries and out of which; four injuries were found simple in nature though said to be caused by sharp cutting weapon and opinion, regarding one injury was kept reserved.
It appears that uptill now, opinion regarding the aforesaid injury has not been received. Moreover, the aforesaid
Patna High Court Cr.Misc. No.17570 of 2016 (2) dt.02-05-2016 2/2 injury was found on the ear of the informant. The investigation against the petitioner appears to have already been completed. The petitioner does not have any criminal antecedent and is languishing in jail custody since 16-02-2016. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dumra P.S. Case No. 179 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi. (Hemant Kumar Srivastava, J) A.K.V./- U T
