JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12.08.2014 in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code.

The accusation against the petitioner is that he along with two others snatched motorcycle of the informant and while they were fleeing, the petitioner was caught by the passersby and in the meantime, police reached there and country made loaded pistol was recovered from his conscious possession. For recovery of firearms, a separate case has been registered against the petitioner and prior to institution of the present case as well as the case of Arms Act, no case had been registered against the petitioner and when petitioner was

Patna High Court Cr.Misc. No.5394 of 2015 (2) dt.11-02-2015 apprehended in the present case, he was remanded in Gwalpara P.S. Case No. 63 of 2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S.
