The petitioner, who is in custody, seeks bail in connection with S. Tr. No. 635 of 2016 arising out of Jogbani P.S. Case No. 79 of 1997 registered for the offences punishable under Sections 302/34, 324, 326, 307/34 and 120-B/34 of the Indian Penal Code and under Section 27 of the Arms Act. Informant who is the uncle of the deceased has alleged that when his nephew along with his friends were coming to his house in a gypsy, petitioner along with other coaccused stopped them and started indiscriminate firing upon them in which his nephew and his friends were killed and others seriously injured. Considering the allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. It has come in the impugned order that case is at the stage of prosecution evidence as such Trial court is directed to expedite and conclude trial within a period of one year from the date of receipt/production of a copy of this order.
