The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 420, 406 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioners are alleged to have misappropriated fund allotted for a government scheme related to construction of road and after completion of work it was found that the work was not done, as per the estimated cost. Petitioner no. 1 is President and petitioner no. 2 is Secretary of the said scheme.

It is submitted that petitioners have been falsely

From perusal of measurement book it appears that the Junior Engineer and Assistant Engineer have jointly verified the work and found the work competed, the expenses incurred over the said scheme were found true. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Khagaria in connection with Beldaur P.S. Case No. 285 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
