2. The petitioner has preferred this application for grant of regular bail in connection with Bidupur P.S. Case No. 682/2024 dated 27.10.2024 registered for the offence punishable u/s 8, 20(b)(ii)(B), 29 of the N.D.P.S. Act.
3. As per the prosecution case, on seeing the police personnel some persons started fleeing away but four man and one women were apprehended and six persons managed to escape away taking the advantage of darkness. Further, the apprehended persons disclosed their names as Mahendra Rai, Ramu Kumar, Kavita Rai, Lalhoming Moya and Lalthang Moya. They also disclosed the names of the persons who fled
Patna High Court CR. MISC. No.55524 of 2025(2) dt.13-08-2025 2/3 away as Jai Prakash @ Jepee, Balam Paswan, Jitendra Rai, Rakesh Rai, Samarjeet Paswan @ Panwa and Krishna Rai. On search, 995 grams of smack, 95 grams of a tobacco-like substance, a total of Rs. 3,34,450/- in various denominations, an ID card and other documents were recovered.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The apprehended person disclosed the name of the petitioner. The other co-accused person has already been granted regular bail by the co-ordinate bench of this court vide order dated 07.03.2025 passed in Cr. Misc. No. 12368/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. Earlier the anticipatory bail of the petitioner was rejected by the coordinate bench of this court vide order dated 14.05.2025 passed in Cr. Misc. No. 8446/2025. Learned counsel has further submitted that the petitioner and the co-accused persons were involved in buying and selling of the Narcotics Substances.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 682/2024, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
