The petitioner apprehends his arrest in Kotwali P.S. case No. 337 of 2019 registered under Section 341, 323, 324, 504, 379/34 of the IPC.

The learned counsel for the petitioner submits that petitioner is owner of Raushan Brothers and the shop of petitioner is situated in front of the shop of informant. The informant alleged that petitioner assaulted him and snatched Rs. 22,000/- from his shop but in fact the petitioner was sitting in front of his shop and the informant along with others assaulted the petitioner and the employee of the petitioner for which Kotwali P.S. case No. 332 of 2019 was registered on 18.04.2019 itself whereas informant of the present case lodged the case for the same occurrence on 19.04.2019.

No.52680 of 2019(2) dt.23-08-2019 2/2 Taking into consideration the aforesaid facts and the fact that there appears to be some scuffle between two shopkeepers for passage of the shops, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. case No. 337 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
