JUSTICE ARVIND SRIVASTAVA ORAL ORDER 15-02-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kanti Police Station Case No. 471 of 2016, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that petitioners are innocent and have not committed any offence. On account of construction on the land, an altercation took place between the parties, who are agnates, and the informant side sustained injury for which the petitioners have been named in the F.I.R.
Learned A.P.P. for the State has opposed the prayer
Patna High Court Cr.Misc. No.3401 of 2017 (2) dt.15-02-2017 for bail of these petitioners and submitted that these petitioners are named in this F.I.R. There is direct allegation of assault by iron rod against the petitioner no.1.
Considering the facts and circumstances of the case and manner of accusation, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, prayer for anticipatory bail of the petitioners is rejected. (Arvind Srivastava, J.) brajesh/- U T
