====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 18-02-2022 Heard learned counsel for the petitioner and Ms. Asha Kumar, learned A.P.P. for the State through virtual court proceedings.

The petitioner seeks bail in connection with Special Excise Case No. 284 of 2021 arising out of Baisi P.S. Case No. 239 of 2021 instituted for the offences under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 41, 47 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.08.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 198 liters of foreign liquor from an

Learned counsel for the petitioner submits that the petitioner is alleged to be the driver of the Ambulance and as such was not knowing that as to which relative of the patient whom the Ambulance used to carry had kept the liquor in the Ambulance.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.08.2021, prosecution report has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Purnia in connection with Special Excise Case No. 284 of 2021 arising out of Baisi P.S. Case No. 239 of 2021.
