Petitioners apprehend their arrest in connection with Mirganj P.S. Case No. 231 of 2014 registered under Sections-147, 148, 149, 323, 324, 307, 504 of the Indian Penal Code and Section-27 of the Arms Act as also Section-3/4 of E.S. Act. Petitioners are named in the first information report but no specific overt act has been attributed against the petitioner No. 1. It is stated that he was simply a member of unlawful assembly. So far as petitioner No. 2 is concerned; it is stated that he hurled bomb, causing injury to the informant as well as his brother. The contention on behalf of the petitioners is that the informant did not sustain any injury, caused by bomb and so far as brother of informant is concerned; he sustained one simple injury said to be caused by the bomb.
Patna High Court Cr.Misc. No.51875 of 2014 (2) dt.05-01-2015 2/2 Taking into consideration the above-said facts and circumstances as well as submission of the parties, in the event of arrest or surrender in the court below within four weeks from today, the petitioner No. 1 namely, Habib Ansari is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mirganj P.S. Case No. 231 of 2014 to the satisfaction of Chief Judicial Magistrate, Gopalganj subject to conditions as laid down u/S 438(2) of the Cr. P.C.
So far as prayer for anticipatory bail of petitioner No. 2 is concerned; the same stands rejected.
