The petitioner, already in custody since 17.02.2018, seeks bail in connection with Khagaria (Muffasil) P.S.Case No. 569 of 2016 registered under Sections 307, 364 and 504/34 of the Indian penal Code and Sections 26/27 of the Arms Act. Learned counsel for the petitioner submits that in his 164 Cr.P.C. statement victim does not name the petitioner as one of the accused being involved in kidnapping and assaulting him and also submits the other co-accused have been admitted to bail by the co-ordinate Benches of this Court. However, accusation is that the informant was kidnapped and one of the co-accused shot at him and the petitioner is also named in the 164 Cr.P.C. statement made by the victim, as one of the member of the criminal gang and an attempt was made by
