2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a), 41 of Bihar Prohibition and Excise Act.

3. 730 liters of foreign liquor has been recovered from a boat near bank of Gandak river.

4. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and merely on suspicion, he has been made accused in this case. Petitioner is neither owner nor sailor of said boat. Petitioner claims clean antecedent.

5. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.57785 of 2023(3) dt.20-09-2023 2/2 from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge IV-cum-Special Excise Court No. II, Gopalganj in connection with Vishambharpur P.S. Case No. 122 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
