JUSTICE MUNGESHWAR SAHOO ORAL ORDER 29-02-2016 It appears that by impugned order dated 16.10.2014 the learned Munsiff Katihar in eviction suit no. 13 of 2007 rejected the written statement filed by the petitioner. This order is under challenged in this writ application.

It may be mentioned here that the written statement was filed by the petitioner pursuant to the order dated 5.7.2012 whereby the petitioner was added as party defendant in the eviction suit. It may be mentioned here that the order dated 5.7.2012 was challenged before the High Court and this High Court by order dated 3.7.2015 passed in C.W.J.C No. 21593 of 2012 has already set aside the order whereby the petitioner was added as defendant no.2.

Now therefore, the petitioner is not party to the eviction suit and accordingly, this writ application has become infructuous and accordingly it is dismissed.
