The petitioner apprehends his arrest in connection with Musahari P.S. Case No. 90 of 2015, registered for the offence punishable under Section 414/34 of the Indian Penal Code. Allegedly, from the scrap shop of the petitioner several parts of different vehicles and motorcycles were recovered and it is alleged that the same are stolen one. Submission is of false implication and that during investigation it has come vide Para nos. 53, 62, 71 & 72 of the case diary, that the petitioner used to purchase the vehicles which met with an accident from insurance company or with from financer which is seized by the financer, the documents have been

Patna High Court Cr.Misc. No.6500 of 2017 (9) dt.09-05-2017 2/2 produced during investigation, he has got no criminal antecedent and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that in those paragraphs of the case diary it has come that the petitioner used to purchase the parts and vehicle which met with an accident and paper has also been produced on behalf of the petitioner. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Muzaffarpur, in connection with Musahari P.S. Case No. 90 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
