JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 23.12.2014 in a case registered for the offences punishable under Sections 363, 366A and 120B of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr. P.C. statement, the victim got her age recorded as 19 years when the court assessed her age as such where she stated that her father fixed her marriage with an old person and since she was in love with the petitioner she married with him. Considering the 164 Cr.P.C. statement of the victim, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.7477 of 2015 (2) dt.02-03-2015 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Ghailadh) P.S. Case No. 661 of 2014.
