This application for anticipatory bail arises out of Complaint Case No. C-1638 of 2018 for the offence punishable under Sections 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
It has been submitted on behalf of the petitioner, who is the husband of the alleged victim, that his wife has also lodged a First Information Report, making certain allegations constituting commission of offence punishable under Section 498A of the Indian Penal Code, giving rise to Pakridayal P.S. Case No.214 of 2018, in which he has been allowed anticipatory bail by an order dated 21.02.2019 passed in Cr. Misc. No. 9150 of 2019. This complaint case has been filed by the brother of the
Patna High Court CR. MISC. No.53128 of 2019(2) dt.26-08-2019 2/2 petitioner's wife.
Considering the facts and circumstances, this application is allowed.
Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Motihari, in Complaint Case No. C-1638 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
