2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 385, 353, 504, 506 & 34 of the Indian Penal Code.
3. It is alleged that the premises of Bihar State Transport Corporation Gata has been illegally encroached by the private bushes and operating their buses on protest by the staff of corporation they assaulted and threatened to corporation staff. It is further alleged that during inspection the informant found that the private vehicle owners taking illegal possession by small and large vehicles and a water pump has also been installed in the northern side of the passenger shade in order to clean the bushes, vehicles as wwell as vehicles owners forcibly
Patna High Court CR. MISC. No.62732 of 2023(2) dt.11-10-2023 2/3 take passengers from corporation vehicles to travel on their own private vehicles and he also found that vehicles bearing Reg Nos. BR02M 8551, BR02W 8442, and BR02PA 5842 were involved.
4. It is submitted that allegation is general and omnibus in nature. The petitioner is the bonafide owner of vehicle bearing Reg. No - BR02PA 5842 and the said vehicle has been hypothecated with the Bihar State Road Corporation under scheduled time of the corporation as allotted by the corporation as such, unauthorized parking and using of the premises of the corporation does not arise . Petitioner claims clean antecedent. Similarly situated co-accused person has already granted bail by this Court vide order dated 25.07.2023 in Cr. Misc. No. 33670 of 2023 .
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Gaya in connection with Tekari P.S. case
