JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Darbhanga Sadar P.S. Case No. 205 of 2012 registered for the offence under Sections-498A/34 of the Indian Penal Code and Section-3/4 of Dowry Prohibition Act.
The petitioner happens to be husband of the informant's daughter and it appears from the first information report that the marriage of the petitioner had taken place with informant's daughter 15 years ago but later on, the differences cropped up between the petitioner and the informant's daughter
Patna High Court Cr.Misc. No.8610 of 2015 (2) dt.09-03-2015 2/2 but due to intervention of well-wishers, the dispute was resolved. Moreover, it appears from perusal of the impugned order of learned Sessions Judge that the informant has already entered into compromise and the victim died of her natural death at her parent's home.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Darbhanga Sadar P.S. Case No. 205 of 2012 to the satisfaction of Sri A. K. Sahay, learned Judicial Magistrate-Ist Class, Darbhanga subject to conditions as laid down u/S 438(2) of the Cr. P.C.
