JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 498A of the Indian Penal Code.
Heard learned counsel for the petitioner.
At the very outset, It has been submitted on behalf of the petitioner that he is ready to keep opposite party no. 2. Learned counsel for the opposite party no. 2 submits that opposite party no. 2 is also agree to live with her husband. Considering the facts and circumstances of the case, let petitioner surrender before the court below, i.e., learned A.C.J.M.,II, Bagaha, in connection with Complaint Case no. 641
Patna High Court Cr.Misc. No.8143 of 2017 (2) dt.27-02-2017 2/2 of 2013 on 9th March, 2017 and make prayer for regular bail. On that day opposite party no. 2 will also appear in the court below and if petitioner desires to take her to his home and opposite party no. 2 also agrees, in such a situation, trial court will grant petitioner provisional bail to his own satisfaction and thereafter, watch conduct of both the parties for the next six months, by getting them appeared on the date fixed on each month. If after six months court below finds conduct of the petitioner satisfactory, he will confirm the provisional bail granted to the petitioner, otherwise he is free to pass any order.
