JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-09-2018 The prayer for bail of the petitioner, in connection with Beur P.S. Case No. 194 of 2016, was earlier twice dismissed as withdrawn vide orders dated 30.11.2017 and 28.03.2018, passed in Cr. Misc. No. 46984 of 2017 and Cr. Misc. No. 9527 of 2018, respectively.
The allegation against the petitioner is of having fired from his weapon killing the deceased.
The charges in this case have been framed on 20.06.2018. This is rather surprising as the petitioner, by
Patna High Court Cr.Misc. No.46420 of 2018 (3) dt.07-09-2018 2/2 now, has remained in Jail for about one year and three months.
I am not inclined to grant bail to the petitioner above named for the present. However, the Trial Court is directed to proceed with the trial in right earnest and conclude the same preferably within a period of nine months from today.
With the aforesaid observation, the petition is dismissed.
