JUSTICE JYOTI SARAN ORAL ORDER 07-01-2015 Heard Mr. Prashant Kumar learned counsel for the petitioner and learned counsel for the State. The petitioner is in custody in connection with Jehanabad P.S. Case No. 03 of 2012 registered for offence punishable under Sections 304B, 201 and 34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The allegation against the petitioner who happens to be the husband of the deceased is of murdering his wife and disposing of the dead body.

It is considering the nature of allegations that the prayer of this petitioner was rejected on 30.09.2013 in Criminal Misc. No. 24303 of 2013 and has been renewed thereafter. It is further submitted that though the case has been committed to sessions giving rise to Sessions Trial No. 45 of 2014 and is pending before learned Ad-hoc Additional District Judge-I, Jehanabad but except for framing of charge, no witnesses have been examined. Having heard learned counsel for the parties and taking note of the circumstances existing, let the petitioner Sanjeet Kumar be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Jehanabad Mahila P.S. No. 03 of 2012 subject to the condition that he shall register his appearance on each and every date fixed in the trial and his failure to do so on two consecutive date without reasonable explanation to the satisfaction of the trial court would entitle the trial court to cancel the bail bonds of the petitioner and to take him into custody.
