The petitioner seeks bail in a case under Sections 394/302 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is not named in the F.I.R. One Hanuman Choudhary was arrested by the police, who is said to have made his confessional statement in para 15 of the case diary. The police also recorded the confessional statement of the petitioner and, in pursuance thereof, some money was said to have been recovered from the house of Brahmeshwar Nath in Village Rasen. The wife of Brahmeshwar Nath disclosed that those articles were kept in her house by the petitioner and Hanuman Choudhary but those articles were not put on T.I.P. Except the confessional statement, there is no material against the petitioner. Considering the facts aforesaid, the above named
Patna High Court Cr.Misc. No.9651 of 2015 (3) dt.24-04-2015 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 1st, Buxar in S. Tr. No. 368/14, arising out of Buxar (Town) P.S. Case No. 122 of 2014.
