The Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 324/326/285/34 of the Indian Penal Code.
Allegation against the petitioner is that he poured acid on the person of the informant. The impugned order reveals that the case of the petitioner was remitted back by the Sessions Court as injury found on the informant was simple in nature and only offence under Section 324 of the Indian Penal Code was attracted against the petitioner. The injury report mentioned in para-23 of the case-diary reveals that extensive kerosene burn injury over the scalp and both the shoulder of the injured was found, which was
Patna High Court Cr.Misc. No.4012 of 2017 (3) dt.16-03-2017 2/2 dangerous for life.
Considering the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner in connection with Bhabua Police Station Case No. 403 of 2015, pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court.
