This application is for grant of regular bail in connection with Katihar Town P.S.Case no.245 of 2018 for the offences under Sections 341, 326, 307/34 of the Indian Penal Code.

Allegation against the petitioner is of stabbing repeatedly to the informant several times.

Submission of the learned counsel for the petitioner is that there is delay in lodging the FIR of 12 hours and further none of the witnesses have supported the case except the informant and one another witness. The petitioner is in custody since 24.4.2018.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.46832 of 2018 (3) dt.19-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, once the charge is framed and the trial is commenced, the learned trial court shall release the petitioner on bail in connection with Katihar Town P.S.Case no.245 of 2018 to his own satisfaction.

With the aforesaid observation, this application is disposed of.
