JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 414/34 of the Indian Penal Code.
One stolen motorcycle is said to have been recovered from the house of the petitioner but at the time of aforesaid recovery, petitioner was not present in his house. Moreover, in the first information report, it is stated by the informant that one Sethi Choudhary had purchased the seized motorcycle from the petitioner but when he came to know that aforesaid motorcycle was stolen property, he threw the said motorcycle in the house of
Patna High Court Cr.Misc. No.16807 of 2016 (2) dt.28-04-2016 2/2 the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that except the present case as well as Khijarsarai P.S. Case No. 344 of 2015, petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Neemchak Bathani P.S.
