====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends arrest in Motihar Muffasil P.S. Case No. 325 of 2013 dated 08.09.2013 instituted under Sections 147/341/323/324/307 of the Indian Penal Code.

The allegation against the petitioner along with eight others is general and omnibus of assault in which one person was also injured.

Learned counsel for the petitioner submits that the niece of the husband of the petitioner is daughter-inlaw of the informant and as per the allegation she had come away with ornaments and money and when they had come to the house of the niece of the husband of the petitioner to take

It is submitted that because of the relationship of the petitioner with the daughter-in-law of the informant, she has been made an accused and it is unbelievable that being a lady, she along with eight others will assault anybody. It is further submitted that the petitioner has no criminal antecedent.

Learned A.P.P.

opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sadar Motihari, East Champaran in Motihari Muffasil P.S. Case No. 325/2013, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
