Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 307, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
This is second attempt of the petitioner for grant of regular bail. Earlier prayer for bail was refused on 17.10.2017 in Cr. Misc. No. 47669 of 2017. Petitioner is in custody since 11.07.2017. The prayer for bail was refused with liberty to renew the prayer if there is undue delay in taking up the trial. Petitioner has stated on oath that there is no
Patna High Court Cr.Misc. No.21367 of 2018 (5) dt.16-07-2018 2/2 progress in the trial.
Allegation of commission of firearm injury and murder is against co-accused Binesh Yadav. However, the petitioner was also accompanying the said accused. Considering the nature of allegation and period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S. Tr. No. 24 of 2018 arising out of Pali Police Station Case No. 24 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
