The petitioner has filed the instant application for grant of regular bail in connection with Khagaria (Muffasil) P.S. Case No. 625 of 2021 registered under sections 341, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. It is a case of opening fire upon the informant by the co-accused persons along with this petitioner, due to which he sustained injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this cased due to village politics. Allegedly, informant has received fire arm injury but there is no injury report available on record to support the prosecution case.

Patna High Court CR. MISC. No.56420 of 2022(3) dt.14-03-2023 2/2 Except suspicion, no other material has come during investigation to show the involvement of the petitioner in the alleged occurrence. He is languishing in judicial custody since 17.06.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Khagaria (Muffasil) P.S. Case No. 625 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Khagaria.
