The petitioner is in custody since 21.08.2014 in connection with Mokama P.S. Case No. 165 of 2014 registered for the offences punishable under Sections 399/402/414 of the Indian Penal Code and 25(1-B)A/26/35 of the Arms Act. As per the prosecution story, the petitioner alongwith others was apprehended by the Police on a suspicion that they were going to commit some crime. Certain articles were recovered from the possession of other accused persons. Allegedly, from the possession of the petitioner, one live cartridge of .315 bore and one Nokia Mobile phone set was recovered. Learned counsel for the petitioner submits that the

No.9531 of 2015 (2) dt.04-03-2015 P2/2 petitioner has been falsely implicated in this case and the other similarly situated co-accused persons have been granted regular bail by this Court vide orders dated 20.02.2015 passed in Cr. Misc. No. 48135 of 2014 (Mohan Sao Vs. State of Bihar), Cr. Misc. No. 48609 of 2014 (Sunil Kumar @ Salo Yadav Vs. State of Bihar) and Cr. Misc. No. 48330 of 2014 (Dharmendra Paswan Vs. State of Bihar) passed on 20.02.2015.

In view of the above, let the petitioner Santa Kumar Kaushal, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna, in connection with Mokama P. S. Case No. 165/2014.
