JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Adhaura P.S. Case No. 48 of 2016, registered under Sections 304(B) and 328/34 of the Indian Penal Code.

The accusation is of killing of daughter of informant by her husband and in-laws due to non-fulfillment of demand of dowry by administering poison.

Learned counsel for the petitioner submits that petitioner, who is the mother-in-law of the deceased, has falsely been implicated in this case. In fact, due to quarrel in between the deceased and her husband, she committed suicide by administering poison, regarding which, information was also given

Patna High Court Cr.Misc. No.2413 of 2017 (2) dt.28-02-2017 to the informant, who came at the house of the petitioner but later on present case has been lodged with false allegation. Moreover, husband of the deceased is in custody.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Kaimur at Bhabua, in connection with Adhaura P.S. Case No. 48 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
