Petitioner, who is in custody, seeks bail in connection with S.Tr. No. 224 of 2018 arising out of Alamganj P.S. Case No. 449 of 2017 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code. Informant who is father of the deceased has alleged that petitioner came at the house of the informant and took away his son on the pretext of attending the marriage ceremony. The son of the informant did not return and on the following day, the dead body of the deceased was recovered near a mobile tower.
It has been submitted that petitioner is innocent and has committed no offence. There is no eye-witness in this case
Patna High Court Cr.Misc. No.56458 of 2018(5) dt.02-11-2018 2/2 the petitioner has been implicated in this case only on the basis of suspicion only. It has been further submitted that similarly placed co-accused has been granted bail by co-ordinate bench of this court in Cr. Misc. No. 38127 of 2018. Petitioner is in custody since 23.11.2017.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-V, Patnacity in S.Tr. No. 224 of 2018. arising out of Alamganj P.S. Case No. 449 of 2017. (S. Kumar, J.) Rajiv/- U T
