JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 03-05-2016 Heard Mr. Ashok Kumar Mishra, the counsel for the petitioner and Mr. Narsing Tanti, APP for the State. The petitioner prays for grant of anticipatory bail arising out of Samastipur R.P.F. Post, Samastipur P.S. Case No. 03/2015, registered under Sections 3 of the R.P. (U.P.) Act. On the basis of the written information submitted by the Commercial Superintendent regarding theft of Rs. 6,03,444/- from the official desk of the Commercial Superintendent and as the matter was not promptly reported to the police, the Commercial Superintendent namely Sohail Ansari is named as an accused in the FIR.
The counsel for the petitioner submits that on the basis of CCTV footage, one Pankaj Kumar Singh and some unknown
Patna High Court Cr.Misc. No.17070 of 2016 (2) dt.03-05-2016 2/3 criminal was arrested and from his possession money was also recovered. In the confessional statement of co-accused Pankaj Kumar Singh the petitioner and others have been named. Pankaj Kumar Singh is a veteran criminal.
The contention of the petitioner is that he is the Assistant Teacher-cum-Incharge Head Master of a Government School. He has no criminal antecedent. One another co-accused Bunti Kumar who was similarly named in the confessional statement of co-accused has been released on anticipatory bail. It is further stated that other co-accused persons whose name figured in the confessional statement of the co-accused Pankaj Kumar Singh have also been released on anticipatory bail by this Court. A bunch of web-copies of these orders has been handed in by Mr. Mishra, which is taken on record and marked 'X' for identification.
In the facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate (Rail) 1st Class, Samastipur in Smastipur R.P.F. (Post), Samastipur P.S. Case No. 3/2015, on condition that one of the bailors shall be his
