JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioner. The petitioner is apprehending his arrest in connection with Sasaram (Muffasil) P.S. Case No. 1254 of 2016 registered for the offences under Sections 302, 120(B)/ 34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that there is no specific allegation of assault against this petitioner and the name of the petitioner came only on suspicion. Heard the learned APP also.

Having heard both sides and in view of the allegation made in the F.I.R. so far the petitioner is concerned, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is rejected.

Let the petitioner, named above, surrender in the court below and pray for regular bail, which shall be considered on merit keeping in view the fact that there is no allegation of assault by the petitioner, without being prejudiced by this order. (Vinod Kumar Sinha, J) BTiwary/- U T
