JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Gaighat Police Station Case No. 137 of 2014 registered for the offences punishable under Sections 420 and 406, of the Indian Penal Code.

The contention on behalf of the petitioner is that prior to registration of this case petitioner filed Complaint Case No. 1817 of 2013 against co-accused Md. Samsul Hoda and the aforesaid complaint case was converted into Bochahan P.S.Case No. 228 of 2013 . It is further pointed out that in the aforesaid Bochahan P.S.Case No. 228 of 2013, the informant of the present case was witness. It is also contended on behalf of the petitioner that the informant has already got the amount in question which is

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Muzaffarpur, in Gaighat P.S.Case No. 137 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
