The petitioner being the brother of the husband of the informant is languishing in custody since 07.01.2015 in a case registered for the offences punishable under Sections 498A, 341, 323, 325, 307, 504/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

It is alleged that the informant Sabina Khatoon was married with Gulabuddin in 2011. Earlier informant filed a case he ended into compromise. It is alleged that accused persons including the petitioner assaulted the informant, though the specific accusation of assault and causing fracture injury is against co-accused Mohammad Nasim. Patna High Court Cr.Misc. No.9568 of 2015 (02) dt.19-03-2015 2/2 has been filed to the effect that the injury report is not on the record.

Considering the thrust of accusation against the husband of the informant and co-accused Mohammad Nasim, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Khaira P.S. Case No. 04 of 2015.
