JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioners seek regular bail in connection with Khaira P.S.Case No. 104 of 2018, registered for offences punishable under Sections 302/34 of the Indian Penal Code. As per F.I.R. allegation against the petitioners is of committing murder of one Raman Kumar Singh.

Submission of the learned counsel for the petitioners is that the petitioners have been falsely implicated in this case and from the F.I.R. it appears that there is no any eye witness of the murder of the deceased and he had been made accused only on suspicion that one Subhasa Devi, sister of the petitioners had illicit

Patna High Court Cr.Misc. No.44704 of 2018 (3) dt.05-09-2018 2/2 relationship with the deceased, and whole allegation is false and concocted and the petitioners are in jail custody since 30.04.2018. Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S.Case No. 104 of 2018, subject to the following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

ii) The petitioners will not induce any witness or tamper with the evidence.
