The petitioner is in custody since 12.12.2014 in a case registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the First Information Report and his name cropped up on the basis of confessional statement of a coaccused. It has been stated in paragraph No. 3 of the application that the petitioner has no criminal antecedent.
