JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Barbigha Police Station Case No. 392 of 2014 registered for the offences punishable under Sections 147, 149, 323, 337, 338, 353, 307, 332, 333, 504, 506, and 427 of the Indian Penal Code. Petitioners are named but no specific overt act has been attributed against these petitioners and having more or less similar allegation some co-accused have already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 26.02.2015 passed in Cr. Misc. No.7659 of 2015. Considering the aforesaid facts and circumstances as well
Patna High Court Cr.Misc. No.9676 of 2015 (2) dt.10-03-2015 2/2 as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Sheikhpura in Barbigha Police Station Case no. 392 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
