ANJANA MISHRA ORAL ORDER 21-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has been in custody since 22.05.2018 in connection with Chakai P.S. Case No. 54/2018 registered for the offences punishable under Sections 366(A) of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire allegation against the petitioner is based on suspicion and the victim girl in her statement made under Section 164 Cr. P.C. has not alleged anything against the petitioner. It is further submitted that the victim girl has stated that she had herself left the house out of her own sweet-will and in her statement under Section 164 Cr. P.C., the victim girl has stated her age to be 18
Patna High Court Cr.Misc. No.43170 of 2018 (2) dt.21-08-2018 2/2 years and that she is a major and can take her own decisions. Learned counsel for the petitioner next submits that only on suspicion and circumstances, the petitioner has been implicated in connection with the present case, and, therefore, the petitioner may be released on bail.
Diary in the present case was called for which has since been received.
Learned counsel appearing on behalf of the State after perusal of the case diary submits that, save and except the allegation, there is no further material in the case diary against the petitioner.
In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 3rd, Jamui, in connection with Chakai P.S. Case No. 54/2018.
