JUSTICE RAVI RANJAN ORAL ORDER 19-02-2015 Heard learned counsel for the petitioner and the respondents.

This application was initially filed by the petitioner for quashing Annexure 1 which is office order no. 47 dated 29.8.2012 issued by respondent no. 3 by which the petitioner was debarred from participating in future tenders. However, subsequently a counter affidavit has been filed appending the office order dated 31.12.2014 issued by the Chief Engineer

Patna High Court CWJC No.22098 of 2014 (4) dt.19-02-2015 2/2 informing that now the petitioner stands relieved from the order of debarment.

In the aforementioned facts and circumstances which has arisen during the pendency of the writ application now the petitioner confines his prayer only for a declaration that Annexure 1 should not be considered at the time of participation in future tenders, i.e., prospectively from the date of order dated 31.12.2014 contained in Annexure C to the counter affidavit. It is, thus, held that Annexure 1 dated 29.08.2012 has already become ineffective after passing of order dated 31.12.2014 so far the future tenders are concerned.
