Petitioner prays for bail in connection with Salkhua (Banma Itahari O.P.) P.S.Case No. 158 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the FIR and later on looted motorcycle was recovered from his possession. Learned counsel for the petitioner has submitted that similarly situated co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 7.3.2018 passed in Cr.Misc.No. 63670 of 2017 and petitioner is in custody since 10.1.2018.

Heard learned APP also, who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.43184 of 2018 (3) dt.14-09-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.

However, once charge has been framed in this case against the petitioner, learned trial court shall release the petitioner on bail to its own satisfaction.

With the above observation, this application is disposed of.
